In the Name of God Amen. Know all men by these presents that I George Hurst of the County of Putnam and State of Indiana, knowing the uncertainty of life, and the absolute certainty of approaching death, do make this my last Will and Testament, as follows, To wit: That is to say, first, after all my lawfull debts and funeral expenses are paid and discharged, I bequeath to my beloved Wife (Elizabeth Hurst), my home farm on which I now live containing one hundred and twenty-three (123) acres more or less, lying in Section two (2) in township thirteen (13) range three (3) West, together with all my personal property moneys and effects, not otherwise herein bequeated during her natural life. 2. I give and bequeath to my beloved Daughter Mallissa Hurst one Clay bank Mare the Colt excepted if she be with foal and provided she pays to my beloved wife seventy five dollars. I give unto my said Daughter one Cow, one bed and bedding. 3. I give and bequeath to my son James R. P. Hurst My Sorrel Horse, and provided he my said son pay to my beloved Wife Seventy five dollars, I give to him one Cow, one bed and bedding 4. I give and bequeath to my son Marion Hurst, provided he pay to my beloved wife Seventy five dollars one Cow, one bed and bedding. This will equalize all my children in advances I have made them. 5. I will that the residue of my lands, to wit: The South east quarter of the North West quarter and the south half of the South East quarter of the South West quarter all of section thirty five (35) in Township fourteen (14) North range three (3) west, estimated to contain sixty acres more or less, be sold by my executors and the proceeds divided equally among my children, to wit: Amos Hurst, Burton Hurst, Isom Hurst, Mahlon Hurst, the heirs of George W. Hurst, deceased, Jesse Hurst, Calvin Hurst, Malissa Hurst, Marion Hurst, and James K. P. Hurst. 6. At the death of my beloved wife Elizabth Hurst, the lands and property bequeathed to her and remaining, I bequeath to my beloved heirs above mentioned equally. Be it remembered that on the 10th day of June 1865 John Adams, one of the Subscribing Witnesses to the within and foregoing last Will and Testament of George Hurst, late of said County, deceased, personally appeared before Melvin McKee Clerk of the Court of Common Pleas of Putnam County, in the State of Indiana and being duly Sworn by the Clerk of said Court upon his oath declared and testified as follows, that is to say: that on the 10th day of March 1865, he saw the said George Hurst sign his name to said instrument in writing as and for his last Will and Testament, and that the said instrument in Writing was at the same time at the request of the said George Hurst and with his Consent, attested and Subscribed by the said John Adama and Milton B. Scott in the presence of said Testator, and in the presence of each other as Subscribing Witnesses thereto, and that the Said George Hurst, Was at the time of the signing and subscribing of the said instrument in writing as aforesaid of full age (that is: More than twenty-one years of age) and of sound and disposing mind and memory, and not under any coercion or restraint as the said deponent verily believes; and further deponent says not John Adams Sworn to and Subscribed by the said John Adams before me Mel McKee, Clerk of said Court at Greencastle, the 10th day of June 1865.
