Will of Elijah Hurst Jr. I Elijah Hurst of the town of Corydon, in the County of Harrison and state of Indiana, being in feeble health but of sound and disposing mind and memory do make or-dain and publish this my last will and testament. Item 1st: I desire and request that my body be buried suitable to one in my condition in life and that all my debts and funeral expenses be paid out of any estate that may leave. Item 2d I devise all the Real Estate of which I may die siezed to my beloved wife Hannah A. Hurst, to have, hold and possess during her natural life, and that at her death it descend and go to my children, Frances E. McGown, wife of James McGown, James A. Hurst, William E. Hurst, Letitia Hurst and Julia Hurst share and share alike or equal proportions. Item 3rd That after the payment of all my first debts and funer- al expenses as recited in Item first, I will and bequeath to my beloved wife Hannah A. Hurst all the residue of my personal property of whatsoever character, to have and hold the same for ever, or to be disposed of in whatever manner she may desire or direct for her use and benefit. Item 4th I hereby constitute and appoint my esteemed friend Alexander Floyd, the executor of this my last will and testament. I witness whereof said testator has hereunto set his hand and seal this 10th day August A.D. 1876. William Farquar Alma E. L. Smith The state of Indiana, Harrison County, SS: Before me, the undersigned, clerk of the Harrison Circuit Court on this 12th day of September 1876, personally came Alma E. L.Smith and produced the within, foregoing and annexed instrument of writing, purporting to be the last will of Elijah Hurst late of said County, deceased, who, being by me duly sworn to state all he knew concerning the ex-ecution of said will, depose as follows: That said Elijah Hurst signed, sealed, published and declared the annexed instrument to be his last will and testament in the presence of the affiants Alma E. L. Smith and William Farquar that they signed their names thereto as subscribing witnesses in the presence and at the request of said testator, and in the presence of each other; that, at the time of executing said last will, said testator was of lawful age to d------ his property, of sound and disposing memory and mind, and not under restraint or coercion in any way whatever, --- further sayeth not.
