WAR OF 1812 Claim of Widow for Pension, under the Provisions of Sections
4736
to 4740 inclusive Revised Statutes, and the act of March 9, 1878. State
of Tennessee
County of McMinn On this 16th day of August A. D. one thousand eight hundred
and
Seventy eight personally appeared before me Lon Blizard Clerk of the County
Court
the same being a Court of Record within and for the county and State aforesaid,
Mary
Hurst aged 89 years, a resident of McMinn County in the State of Tennessee,
who,
being duly sworn according to law, declares that she is the widow of Elijah
Hurst
deceased, who was the identical Elijah Hurst, who served under the name
of Elijah
Hurst as a Private in the company commanded by Captain Hunter, in the regiment
of
Drafted Men, commanded by Col John Hill, in the war of 1812; that her husband
was
drafted at Big Spring, Claiborne County Tennessee on or about the [blank]
day of
Oct. or Nov., A. D. 1814, for the term of 6 months and continued in actual
service
in said war for the term of from 15 to 20- days and whose serviced terminated,
by reason of furnishing a substitute. {blank] states that the following
is a full description
of her said husband at the time of his enlistment, viz: Weight about 160
pounds, medium
height, fair complexion. She further states that she was married to the
said Elijah Hurst
in the county of Claiborne, and in the State of Tennessee, on the 28 day
of July A. D.
1808, by one Joab Hill, who was a Justice of the Peace and that her name
before her
said marriage was Mary Lane that neither herself or her husband (the soldier)
had been
previously married and that her said husband Elijah Hurst, died in McMinn
County in the
State of Tennessee, on the 15 day of December, A. D. 1844, and she declares
that the
following have been the places of residence of herself and her said husband
since the
date of his discharge from the Army, viz: Claiborne County Tennessee until
1820 and
since that time in McMinn County, Tennessee. She makes this declaration
for the
purpose of obtaining the pension to which she may be entitled under the
provisions
of Sections 4736 to 4740 inclusive Revised Statutes, and the Act of March
9, 1878,
and hereby constitutes and appoints with full powers of substitution and
revocation
W. S. Gaston of Athens, McMinn Co., Tenn, her true and lawful attorney
to prosecute
her claim, and she further declares that she has made no application for
Bounty, land or
pension and that her residence is County of McMinn, State of Tennessee,
and that her
post-office address is Athens, McMinn County, Tennessee.

Also personally appeared Jemima Cleage, age 64 years, residing in Athens,
McMinn County, Tennessee, and William H. Ballew, aged 63 years, residing
in Athens, McMinn County,
Tennessee, persons whom I certify to be responsible and entitled to credit,
and who,
being by me duly sworn, say that they have known the said Mary Hurst for
64 years
and for 45 years, respectively; that they were present and saw her sign
her name
(or make her mark) to the foregoing declaration; that they have every reason
to believe,
from the appearance of said claimant and their acquaintance with her, that
she is the
identical person she represents herself to be; and they further say that
they are able to
identify her as the person who was the wife of the identical Elijah Hurst,
who rendered
the service alleged in the above application (in the company of Captain
Hunter, in the
the regiment of Drafted Men, in the war of 1812) by the following-named
facts and
circumstances, viz: The said Jemima Cleage is a daughter of claimant and
said soldier
and said W. H. Ballew has lived a near neighbor to and been well and intimately
acquainted with claimant and her said husband since about the year 1835
and that
they have no interest in the prosecution of this claim.

certify that the contents of the above declaration, &c., were fully
made known and explained
to the applicant and witnesses before swearing, including the words [blank],

and the words [blank], added; and that I have no interest, direct or indirect,
in the
prosecution of this claim.

Second Amended Application War of 1812 Act March 9, 1878 State of Tennessee
County of Claiborne Before Me R. A. Ellis clerk of the County Court for
County and
State aforesaid which is a Court of Record personally appeared Mary Hurst
of County
and State aforesaid to me well known who I certify to be respectable and
entitled to
credit says that she is the identical Mary Hurst who on or about the 16
day of August
1878 executed her original application for pension and on or about May
21, 1879 her
amended application thereto; that in her original application she alledged
that her husband
Elijah Hurst dec´d served as a Priv. in Company commanded by Capt.
Hunter in Regt.
of Drafted Men commanded by Col. John Hill; that in her said amended application
she alledged the information that his Capt was by the name of Capt, Hamilton
of said
Col´s Regt. as will be more fully seen by refferance [sic] to said
Original and Amended
applications and she has been informed that said soldiers name is not found
on the rolls
of Capt. Hamiltons Co. Tenn. Mil. War of 1812 and by letter dated Sept.
4, 1879 that
there is no record of any regiment of Tenn. Militia commanded by Col. Hill.
She comes
now and states in this her second amended application that she can not
possibly be
mistaken as to her said husbands service in said Col. Hill´s Regt.
because said Col. Hill
was a brother in law of Claimant and lived a near neighbor to her and she
was well
acquainted with him at the time, and the said statement in the said letter
to her the
contrary has been caused by some over sight; that her original and amended
application
as to his Capt. and that she has been informed by one Oliver Dodson who
was a soldier
in said Col. Hill´s Regt. or volunteered to serve in said Regt. that
her said husband´s
Capt. was Capt. Solomon Dobbins and that he said Dodson was a neighbor
to and
well knew said Captain Dobbins and was also well acquainted with claimant
and her
said husband and claimant comes now and alleges in such information that
her said
husband Elijah Hurst served in Capt. Solomon Dobbins Company Col. John
Hills Regt.
and comes and asks that this be filed and received as her second amended
application
and that her said case be reopened and prosecuted with.
