To clarify this document, so that there is no confusion, this is a chancery case heard in the Fairfax County Circuit Superior Court for the estate of William Hurst, one of the sons of John Hurst (d. ca. 1789) of Fairfax Co. This was finalized in 1848 when William Hurst’s share of his father’s land was finally sold. William Hurst was born 1 December 1750 and died 23 December 1831. He is buried at Hurston, the Hurst Family burying grounds in Jefferson Co., West Virginia. William Hurst, son of John Hurst, was declared of "unsound mind" by the Fairfax Co. court in 1788 and his brother, James Hurst (who died in Jefferson Co.) was appointed his guardian (Fairfax County, Va. Court Minutes 1788:351). Apparently William died DSP. ------------------ Hurst vs. Hurst Heirs This case coming on again to be heard this [blank] day of Nov. 1849, Upon the papers formerly read together with the report of the commissioners of sale, and Report of A. Moss special commissioner and no exception having been filed to said report they are hereby confirmed and it appearing to the satisfaction of the Court that William Nelson the purchaser of the tract of land in the proceedings mentioned, hath fully paid up the purchase money & complied with the terms of the purchase, and is thereby entitled to a deed - the Commissioner of sale James Thrift is hereby directed to convey the tract of land aforesaid to the said William Nelson. And it appearing from the report of Commissioner Moss that after deducting costs and expenses there remains the sum of five hundred thirty-two dollars & ninety-two cents ($532.92) for distribution among the seven brothers and sisters of Wm. Hurst, Decd Them and their Heirs - and the said James Thrift is hereby directed to distribute and pay out the said fund in accordance with the report of Commissioner Moss Viz: To the Heirs of James Hurst one of the brothers of Wm. Pursuant to the decree of the Circuit Superior Court of Law and Chancery for Fairfax County in the case of Hurst & others against Hursts’ heirs,pronounced at Nov. term 1848, the undersigned the commissioner therein named, being required to ascertain the names of the heirs & to apportion the fund arising from the sale of land amongst them, advertised for the heirs to furnish the information required. The following is the result & although of a very unsatisfactory character, yet it is the best report that can be made under the circumstances. Many of the heirs imigrated to the west years ago, & have rarely visited or corresponded with their relations here, and little is known of them.
